PEN International is deeply concerned at the arbitrary detention of Omani poet and intellectual Abdullah Habib. His recent arrest immediately followed the decision of the Muscat Appeals Court, on 2 April 2018, which upheld a three-year sentence against him with six months to be served in prison. Habib was taken directly to the accommodation centre at Samail Central Prison where he remains detained with around 40 other intimates, mainly undocumented migrants and others charged with committing crimes related to drug trafficking. Since his arrest, and despite his frail mental and physical health, Habib has only had intermittent access medication, and is not allowed to keep it with him.
Habib has been convicted of contempt for religion, spreading hatred, blasphemy, and “using the Internet to publish material that prejudice the public order or religious values”. PEN International believes that Habib has been targeted for his peaceful activism and is calling for his immediate and unconditional release.

Send Appeals to the Omani authorities:
Calling on them to immediately and unconditionally release Abdullah Habib and to ensure the full respect of his right to freedom of expression;
Asking them to ensure that while detained, he is protected from torture and other ill-treatment, has regular access to a lawyer of his choice, his family, and appropriate medication and medical treatment;
Urging them to accede to the International Covenant on Civil and Political Rights without delay;
Reminding them that, in line with the UN’s 1998 Declaration on Human Rights Defenders, the government must provide protection to human rights defenders, including against any violence, threats, retaliation or any other arbitrary action as a consequence of the legitimate exercise of their rights.

Background:
Abdullah Habib is a prolific writer, film-maker and intellectual who has written extensively on film. He holds a PhD/ABD (2005) in Critical Film Studies from the University of California, Los Angeles (UCLA), where he has taught courses in “Third World Cinema”, and “Cinema and Social Change”. A member of the founding committee of cinema in the Gulf Cooperation Council (GCC), he has also directed several short films, including “The Statue” and “This is Not a Pipe”, for which he received the Abu Dhabi Cultural Association Award in 1992. Habib has also published twelve books of poetry and short story collections. In 2013, Habib was honoured by the General Secretariat of the Gulf Cooperation Council for his excellence in cultural production.
Habib has been previously subjected to multiple arrests. He was firstly arrested on 15 April 2016 and released without charge on 4 May 2016. This arrest followed a Facebook post in which Habib urged the Omani government to reveal the burial sites of ‘Group 72’ and ‘Group 74’, groups of rebels who were executed by the government during the Dhofar rebellion in the 1960s and 1970s. On 11 July 2016, Habib was arrested again after he published comments and posts on his Facebook page during the month of Ramadan, relating to fasting and prayers in the Islamic faith. He was released on 28 July 2016, pending his trial.
On 8 November 2016, Habib was sentenced to three years in prison and a fine of 2,000 OMR (c. US$2,600), convicted on charges including contempt for religion, spreading hatred, blasphemy, and “using the Internet to publish material that prejudice the public order or religious values”. (For more information, see Article 19 of the Royal Decree No 12/2011 Issuing the Cyber Crime Law). His appeal hearing was regularly postponed throughout 2017, and finally held on 2 April 2018 when the Muscat Appeals Court upheld his sentence. PEN International has been campaigning for Habib’s release and for the charges against him to be dropped.
The situation for freedom of expression and opinion in Oman continues to deteriorate. Many writers and activists have been arrested or forced to flee the country. According to a recent report, the internet activist Hassan al-Basham passed away on 28 April 2018 while serving a three-year sentence in Samail Central Prison after a sudden deterioration in his health. Al-Basham had been charged with "the use of the Internet in what might be prejudicial to religious values, and "insulting the Sultan". PEN continues to call on the Omani authorities to protect the rights of all persons to freely express their views, whether as citizens, journalists, or writers, in line with international human rights standards.

عُمان: اعتقال تعسّفي لشاعر وناشط

تعرب منظّمة القلم الدولي عن قلق شديد حيال اعتقال الشاعر والمفكّر العُماني عبدالله حبيب بشكل تعسّفي. واُوقف الكاتب مباشرة بعد قرار محكمة الاستئناف في مسقط في 2 نيسان/أبريل 2018 تأييدها حكم سابق بسجنه لمدّة ثلاث سنوات يقضي منها ستّة أشهر في السجن. وقد اُقتيد حبيب مباشرة إلى سجن سمائل المركزي حيث يبقى محتجزاً مع حوالى 40 شخصاً، هم بالإجمال مهاجرون غير مسجّلين وآخرون متّهمون بارتكابهم جرائم تتعلّق بالاتجار بالمخدّرات. ومنذ اعتقال حبيب، وعلى الرغم من ضعف حالته الصحية الجسدية والعقلية، لم يتمكّن من الحصول على دوائه إلّا بشكل متقطّع ولا يُسمَح له بأن يبقيه معه.
لقدّ تمّت إدانة حبيب بتهم التجديف على الذات الإلهية واستخدام تقنية المعلومات للإساءة للنظام العام والمساس بالقيم الدينية. وتعتقد منظّمة القلم الدولي بأنّه تمّ استهداف حبيب بسبب نشاطاته السلمية، وتدعو بالتالي إلى إطلاق سراحه فوراً وبدون شرط.

دعوتها إلى الإفراج الفوري وغير المشروط عن عبدالله حبيب والحرص على احترام حقه في حريّة التعبير؛
مطالبتها بالحرص في أثناء احتجازه على حمايته من التعذيب والمعاملة السيّئة وحرّية التواصل مع محامٍ من اختياره ومع عائلته، وحصوله على دوائه وعلاجه الطبّي الملائمَين؛
حثّها على الانصياع للعهد الدولي الخاص بالحقوق المدنية والسياسية من دون تأخير؛
تذكيرها بأنّه، وفقاً لإعلان الأمم المتحدة المتعلّق بالمدافعين عن حقوق الإنسان الصادر في العام 1998، على الحكومة أن تلتزم بتأمين الحماية للمدافعين عن حقوق الإنسان، بما فيها الحماية من أعمال العنف والتهديد والانتقام أو أيّ تصرّف تعسّفي آخر نتيجة ممارستهم حقوقهم الشرعية.

خلفية:
عبدالله حبيب كاتب ومخرج ومفكّر غزير الإنتاج، تعمّق في الكتابة عن الأفلام. وقد حازَ في العام 2005 شهادة دكتوراه بدون أطروحة في الدراسات النقدية السينمائية (PhD/ABD) من جامعة كاليفورنيا في لوس أنجلس حيث أعطى دروساً في مادّتَي "سينما العالم الثالث" و"السينما والتغيير الاجتماعي". وقد أخرج أيضاً، بصفته عضواً في اللجنة المؤسّسة للسينما في مجلس التعاون الخليجي، أفلاماً قصيرة من بينها: "تمثال" و"هذا ليس غليوناً" الذي فاز بجائزة المجمع الثقافي في أبوظبي في العام 1992. وقد نشر حبيب أيضاً اثنَي عشر ديواناً من الشعر ومجموعات قصص صغيرة. وفي العام 2013، كرّمته الأمانة العامّة لدول مجلس التعاون الخليجي على تميّزه في الإنتاج الثقافي.
وقد سبق أن اعتُقل حبيب مرّات متعدّدة. فقد ألقي القبض عليه في 15 نيسان/أبريل 2016 وأُطلق سراحه من دون تهمة في 4 أيّار/مايو 2016. وقد أتى اعتقالَه عقب منشور على فيسبوك حثّ فيه حبيب الحكومةَ العُمانية على الكشف عن مواقع جثامين مجموعتَي 72 و74، وهما مجموعتا ثوّار أعدمتهما الحكومة في خلال ثورة ظفار في ستينيات القرن الماضي وسبعينياته. وفي 11 تموز/يوليو 2016، تمّ اعتقال حبيب مجدداً بعد نشره تعليقات ومنشورات على صفحته الشخصية على فيسبوك خلال شهر رمضان، مشيراً إلى الصوم والصلاة بحسب الإيمان الإسلامي. وقد أُطلق سراحه في 28 تموز/يوليو 2016 بانتظار محاكمته.
وفي 8 تشرين الثاني/نوفمبر 2016، صدر حكم بحقّ حبيب بالسجن لمدّة ثلاث سنوات مع دفع غرامة قدرها ألفَي ريال عُماني (أيّ 2600 دولار أمريكي)، وأدين بتُهمٍ، من بينها نشر الكراهية والتجديف واستخدام شبكة الإنترنت لنشر موادّ تتحامل على القانون العامّ والقيم الدينية. (للمزيد من المعلومات، راجع المادّة 19 من المرسوم الملكي رقم 12/2011). وقد تمّ تأجيل جلسة الاستئناف عدّة مرات طوال عام 2017 لتنعقد مؤخراً جلسة حكم في 2 نيسان/أبريل 2018 عندما أيّدت محكمة الاستئناف في مسقط الحكم الصادر سابقاً بحقّه. وقد أجرت منظّمة القلم الدولي حملات لإطلاق سراح حبيب ولإسقاط التّهم الصادرة بحقّه.
ولا تزال مسألة حريّة الرأي والتعبير في عُمان تشهد تراجعاً. فقد اعتُقل الكثير من الكتّاب والناشطين أو أُجبروا على الهروب من بلادهم. وبحسب تقرير صدر حديثاً، توفي الناشط على الإنترنت حسن البشّام في 28 نيسان/أبريل وهو يقضي عقوبته بالسجن لمدّة ثلاث سنوات في سجن سمائل المركزي بعد أن تدهورت حالته الصحّية. وقد واجه البشّام تهمة "إستخدام الشبكة المعلوماتية في ما من شأنه المساس بالقيم الدينية" و"إهانة السلطان". وتتابع منظّمة القلم الدولي بدعوة السلطات العُمانية إلى احترام حقوق جميع الأفراد بالتعبير بحريّة عن آرائهم، سواء مواطنين كانوا أم صحافيين أم كتّاباً، بما يتوافق مع معايير حقوق الإنسان الدولية.
